Justice for Charleena Lyles is Impossible

[TRIGGER WARNING: POLICE BRUTALITY, MURDER, VICTIM BLAMING]

This is exactly why I'm working on the De-Escalate campaign. Because police in Washington State have functional immunity. The "malicious intent" standard is combined with the "good faith"  standard here, meaning you have to prove both that an officer went against their training and consciously decided to murder someone out of pure malice. How the fuck do you prove that? You don't. Because you can't.

I-940 would also mandate independent investigations into incidents of force, because right now, the police just investigate themselves, and this happens:

The Seattle Police Department’s Force Review Board has found the fatal shooting of Charleena Lyles by two officers in June to be reasonable, proportional and within policy, according to sources familiar with the decision. 
The board’s unanimous vote occurred during a meeting Tuesday that began at 9 a.m. and lasted until about 5 p.m., said one source with direct knowledge of the proceeding.

The story the officer tells in the article, which I don't trust, still doesn't make sense.

McNew said he considered running out of the apartment, but he couldn’t because Lyles was visibly agitated, holding two knives, with her children at her feet.

?? What, are you suggesting you thought she was gonna stab her own children? I think it's clear that her problem was with cops, you asshole.

But it doesn't matter. Because police are trained to shoot anyone attacking them with a knife, no matter if she's a 90-pound tiny woman, no matter if there are "children at her feet" who could have been shot as well.

Honestly, even if I-940 had already passed, I think it's very unlikely that Charleena could have been saved or received justice. But it's a first step. Next step, stop training cops to bring a gun to a knife fight.
